MEDiEN ... industrie darauf einigen, wer derzeit ihr gefaehrlichster Gegner ist – die Chancen staenden nicht schlecht, dass dieser Titel an Justin Frankel, 24, aus San Francisco verliehen wird. Seit seine Firma Nullsoft von AOL Time Warner gekauft wurde, ist der Mann Angestellter beim groessten Medienkonzern der Welt – aber das hindert ihn nicht daran, sich weiterhin ... Programme auszudenken.
Im Maerz 2000 stellte er die kostenlose Tauschsoftware Gnu**lla probeweise ins Netz - und als der Mutterkonzern die Sprengkraft dieses Programms erkannte, war es schon zu spaet: Das Prinzip des dezentralen 'File*haring' war geboren. Und damit alle Probleme, die der Musikindustrie derzeit den Schlaf rauben.

Vergangenen Mittwoch liess Frankel, ... ... eine neue Bombe hochgehen. Fuer wenige Stunden war das Programm 'Waste' auf der Nullsoft-Website verfuegbar bis AOL die Notbremse zog, die Dateien in den Giftschrank verbannte und eine Warnung publizierte: Jeder, der ... "Waste" ... heruntergeladen habe, muesse es umgehend und vollstaendig vernichten ->

Der Grund fuer die Aufregung ist klar:
'Waste',
benannt nach einem geheimen Postsystem aus der Fantasie des Schriftstellers Thomas Pynchon großes Grinsen ,
erlaubt erstmals File*haring mit perfekter Verschluesselung.
Damit ist die naechste Stufe erreicht - laengst bieten Dutzende von ... Websites 'Waste' zum Herunterladen an.

Dies wirkt wie die hoehnische Antwort der Programmierer auf den letzten Vorstoss der Entertainment-Giganten.
Ende April 2003 ... verklagte die Musikindustrie die Studenten Daniel Peng, Joseph Nievelt, Aaron Sherman und Jesse Jordan, weil sie ... dateien fuer eine begrenzte Gruppe (sprich: ihre Mitstudenten) aufgelistet und zugaenglich gemacht hatten.
Die vier wurden schlagartig beruehmt, weil sie bald zu den aermsten Menschen der Welt gehoeren koennten:
Ginge es nach dem Willen ihrer Verfolger, muessten sie mehr als 90 Milliarden Dollar Schadensersatz bezahlen.
Schon morgen jedoch werden ihre Nachfolger solche Netzwerke wieder installiert haben - verschluesselt mit 'Waste'.

Die Botschaft ist klar: Drakonische Verfolgung fordert die Hacker nur heraus und der Erfindungsreichtum von Leuten wie Justin Frankel wird mit Gerichten und Gesetzen nicht zu stoppen sein. Aber gibt es nicht auch Anzeichen dafuer, dass die Konsumenten freiwillig fuer ein gutes angebot bezahlen? Die staendigen Erfolgsmeldungen aus dem Hause @pple suggerieren dies: Der neu eroeffnete Internet Store ... laeuft bestens: Mehr als drei Millionen Songs haben die User schon gekauft. Endlich eine legale Moeglichkeit, Musik aus dem Netz zu laden, unkompliziert zu bezahlen, zu brennen oder auf tragbaren Geraeten anzuhoeren. Endlich alle grossen Labels dabei, endlich kein Grund mehr, sich ueberhaupt etwas *llegal zu besorgen?

jaaaaaaa,
das ist natürlich ne neue qualität, nicht, das überhaupt copyright geschütztes material getauscht wird, sondern, das, egal WAS es nun wäre, es ohne jede kontrolle durch solche, die immer alles kontrollieren wollen, getan werden könnte.
da dürfte weniger aol als noch ganz andere institutionen die notbremse gezogen haben... großes Grinsen


nachdem musik- und filmindustrie meist über dritte interessenvetreter die härtere gangart eingeschlagen haben, programmieren sich alle momentan den wolf, um von den etablierten p2p wegzukommen, die ALLE, und da sollte sich keiner was anderes einreden, die nutzer über 2, 3 schritte bis auf die adresse ermitteln lassen.
nur, das das risiko bisher kalkulierbar war. selbstverständlich objektiv betrachtet zu recht, denn urheberrecht ist urheberrecht, punkt.
allerdings ist die argumentation der medienindustrien, WARUM die nutzer dieses risiko eingehen, nicht mehr zeitgemäss, es ist nämlich mitnichten kriminelle energie, sondern der wunsch nach mehrwert: test vor kauf, allerdings meistens test und wegwerf, weil viel zu viel schrott für teuer geld angeboten wird, das man dann froh ist, NICHT ausgegeben zu haben...Augenzwinkern
jaja, die powersauger gibt es, und die, die sich ausschliesslich wegen "haben wollen" bei p2p rumtreiben, haben auch den prozentual höchsten anteil.
nur: die sind eben nicht dran schuld, das es den jammernden medienriesen schlecht geht, sondern das ist immer noch hausgemacht, aber es ist halt zu schön, in der aktionärsversammlung die verantwortung für die eigene misswirtschaft auf ein paar donkey-user abwälzen zu können.

ok, bogen zurück: wenn es gelingt, eine p2p basis durchzusetzen, die von aussen nicht angreifbar ist, werden die medienkonzerne gewzungen, OHNE die rechtliche keule gegenmassnahmen zu enwickeln.

mal sehen, ob sie dann auf den trichter mit "bezahlbarer qualität" kommen.... pfeifen

Nullsoft has released a beta version of a new tool called WASTE designed to secure communication within small groups of users. The brainchild of Winamp creator Justin Frankel, WASTE utilizes encryption and public keys to keep sensitive data hidden from prying eyes. WASTE currently features instant messaging and chat capabilities, along with file sharing functionality with support for browsing and searching. At the core of WASTE lies a distributed architecture that creates a web of networked hosts.

within hours, higher ups at AOL pulled the code from the site and replaced it with a terse notice, scripted in legalese, that warned anyone who downloaded the program that they had „no lawful rights“ to the software and that „any and all“ copies of it must be destroyed.

It wasn’t the first time this happened. In 2000, during the height of the Napster craze, Frankel posted the program to Gnute**a on Nullsoft.com, only to find the code yanked a few hours later. Those few hours were enough for the code–a decentralized peer-to-peer (PtoP) program–to be downloaded by enough key people to turn Gnutella into a major force in the PtoP world. Today, Gnutella-based programs have been downloaded more than 35 million times.

Does the same future await Waste? Perhaps. The program has already been downloaded more than 1,600 times, according to several people who put up „mirror sites“ featuring the code. Though 1,600 downloads might not sound impressive compared to the Gnu**lla's 35 million, it shows strong interest in the program–especially since it was only available on the official site for a couple of hours. Despite AOL’s warning, more than 20 mirror sites are still running. AOL apparently has thus far chosen not to crack down too strongly on the mirrors, though it’s difficult to say how long that will last. A Yahoo! discussion group about Waste has already formed. But before analyzing Waste’s future, it’s important to understand what is it–and isn’t–today.

Whenever Frankel releases code, legitimately or not, it’s news. He’s a programmer of remarkable pedigree, having created WinAmp (the most popular MP³ software player) and Sh0utcast (streaming radio), as well as Gn**ella. But perhaps hoping to stoke another Gn**ella-sized frenzy, the first news stories erroneously pegged Waste as a file-trading application. File-tr@ding is certainly a component of Waste, but it doesn’t appear to be its primary function.

Since the code is in a „1.0 beta“ stage, it’s hard to tell exactly what it wants to be; Frankel didn’t respond to repeated requests for information and AOL had no comment on Waste. But after spending some time with Waste and speaking with coders who are already at work improving it, a clearer picture emerges. „Given the amount of effort Justin put in, which clearly wasn’t huge, it’s off to a great start,“ says Ray Ozzie, CEO of Groove Networks and creator of Lotus Notes, who has played around with the software.

Waste differs from AOL Instant Messenger in the same way that Gnu**lla differed from Napster: it doesn’t use a central file server. A Gn**ella network is really a network of networks, using an indeterminate number of servers located close to the user (in cyberspace distances), rather than a dedicated machine.

Waste combines this aspect of Gn**ella with AIM’s messaging features, but there is a twist. Gnutella builds interlocking networks that span the Internet, while Waste networks are small–ideally 10–20 computers, with a practical limit of about 50. Also, unlike Gn**ella or AIM, Waste incorporates publicly available encryption for security, making the software useful for corporate work groups. Indeed, it was used internally at AOL before the public release.

Contrary to many reports in the popular press, Waste is not the threat to commercial on-line music services that Gn**ella is thought to be. While there are file-sharing elements to Waste, including the ability to swap muzak files, they are merely the same capabilities that AIM and other instant messaging programs have.

Waste is, on the other hand, a danger to AOL’s instant messaging service by being a ptop, and therefore uncontrollable, version of it. Waste users don’t need to log in to a centralized IM server such as AOL’s. Indeed, any two or more Waste users can start messaging one another or form a chat group without any server at all. The program uses a form of multicasting to broadcast each user’s identity and messages to all others in the network (and such multicasting imposes an upper bound on the size of the group since beyond a certain point, there would be too much network traffic).

According to Lucas Gonze, a New York City-based freelance software engineer who has looked at the Waste software code, the program threatens the main market advantage to AOL’s AIM program, its user base. According to one estimate, AOL has about 60 percent of the public IM market, with Yahoo Inc. and Microsoft Corp. roughly splitting the remainder. Noting that the different messaging services don’t interoperate with one another, Gonze says, "AOL's strategic leverage is that it has the largest base of users, and hence is the easiest way to reach somebody over instant messaging. Waste is scorched earth for AIM."

Time will tell whether that’s true. At the moment, tech-savvy users are merely playing with the software and fiddling with the code. But based on Frankel’s past successes, and AIM’s key role in differentiating AOL’s service from its competitors, his employer is probably right to be concerned.
